How To Check a Person’s Public Criminal Records

There are many jobs which require people who are being employed to be of clean character and trustworthy. These could be jobs where a person is being employed as a nanny or a tutor to a child or persons who have to handle cash matters in office. It is possible for the employer to conduct a criminal background check on the person. Firstly, he needs to get the consent of the job applicant who will fill up an application form providing his/her full name, date of birth, social security number, and address and other details and sign on it authorizing the employer to conduct the search.

The potential employee has to give his/her fingerprints that will be submitted to the local law enforcement office. There, the fingerprints are scanned into the computer and the database checks for the person’s criminal record. If the fingerprints match any one that is already in the database, the record of the person will show up. A small fee is charged for the process that is paid by the employer. The employer can then have a look at the applicant’s criminal record to verify whether the person has any past crimes registered against him/her, any arrest warrants or jail sentences. A copy of the criminal record must also be handed over to the person whose criminal record has been taken out.

There are states that maintain a central website where they maintain public records of all persons residing in that state. If you wish to find out whether the concerned person has committed any crime in that state, you can gather information on this website. It is possible that a state website has different type of information on different links. So, it is necessary that you research well on the site and look for links that can lead you to criminal records of persons in that state. However, not all states maintain a website. You will want to do a criminal background search.

In case you were acquitted in a case after not being found guilty, then you can apply for expungement of the case from your criminal record after around 60 days of the court judgement. This time could vary from state to state. If you were found guilty, then you can apply for expungement after around five years after the judgement was accorded. But, this too, depends on the rules and regulations in each state and on the severity of the crimes committed by you.

Minor offenses such as jumping signals, speeding tickets or juvenile crimes where you must have gone through community service to make up for it are not included in criminal records. In cases where you were arrested and later acquitted, it will show on your criminal record but will not be given access to the public. It will be accessed only by law enforcement officials and you can apply for expungement.

Just by paying a small fee, you can easily check a person’s criminal background and gauge whether the person is suitable for the job or not. This ensures safety of your organization and family members.
